Your photographs are delivered in a private online gallery, where you can view, download, and share your high-resolution images with family and friends.
Please note that your online gallery will remain available for 14 days after delivery, so we recommend downloading and backing up your photos as soon as you receive them.
At this stage, neoGraphy does not offer printed photographs or albums as part of our standard services.
All edited photographs are delivered digitally in high resolution through a private online gallery, making them easy to download, save, and share with family and friends.
If you require professional prints or a wedding album in the future, these can be arranged as an optional add-on on request.
No. neoGraphy does not provide props for photoshoots as part of our standard packages.
We encourage clients to bring any personal items or meaningful props they'd like included in their session, such as flowers, signs, gifts, cultural accessories, or other special items.
If your shoot requires a specific setup or themed décor, we can discuss this during the planning stage and arrange it as an optional add-on where available.
These Terms & Conditions ("Terms") govern all photography, videography, livestreaming, wedding coverage, event coverage, corporate video production, social media content, music video production, live DVD production, product photography and related creative services provided by neoGraphy Tv ("neoGraphy") to the client ("Client").
These Terms apply together with the applicable quotation, invoice, package description, booking confirmation and any other written agreement issued by neoGraphy.
1. ACCEPTANCE OF THESE TERMS
1.1 By paying the booking fee, making any payment towards a booking, accepting a quotation, signing a quotation or agreement, confirming a booking in writing, or instructing neoGraphy to commence work, the Client confirms that they have read, understood and accepted these Terms.
1.2 These Terms form part of the agreement between neoGraphy and the Client.
1.3 Where a specific written quotation contains a term that differs from these Terms, the specific written term in the quotation will apply to that particular service or booking.
1.4 Any variation to these Terms must be agreed in writing.
2. QUOTATIONS AND PRICING
2.1 All quotations are based on the services, coverage hours, locations, personnel, equipment and deliverables communicated to neoGraphy at the time the quotation is prepared.
2.2 A quotation is valid for the period stated on the quotation.
2.3 If no validity period is stated, neoGraphy reserves the right to amend the quotation before the booking is confirmed.
2.4 A quotation does not constitute a confirmed booking.
2.5 Additional services, hours, locations, personnel, equipment, editing, revisions, deliverables or other requirements requested after acceptance of the quotation may result in additional charges.
2.6 Prices are quoted in South African Rand (ZAR).
3. BOOKING FEE AND PAYMENT STRUCTURE
3.1 A 30% booking fee is required to secure the Client's date.
3.2 The booking fee is calculated against the total quoted project value.
3.3 The booking fee secures the agreed date and allows neoGraphy to allocate personnel, equipment and production resources to the booking.
3.4 The booking fee is subject to the Client's statutory cancellation rights under applicable South African law.
3.5 Any amount paid above the required 30% booking fee is treated as a payment towards the outstanding balance and not automatically as an additional non-refundable booking fee.
3.6 The outstanding balance is due no later than 7 calendar days before the scheduled session, event or production, unless otherwise agreed in writing.
3.7 Where the Client has paid more than 30% before the final balance becomes due, the additional amount will be credited against the outstanding balance.
3.8 All payments will be recorded against the Client's account.
3.9 neoGraphy accepts payment by EFT or cash unless otherwise agreed in writing.
3.10 A payment is considered received once cleared funds are available to neoGraphy.
4. CANCELLATION BY THE CLIENT
4.1 The Client may cancel an advance booking in accordance with applicable South African law, including the Consumer Protection Act 68 of 2008.
4.2 Section 17 of the Consumer Protection Act permits a supplier to require a reasonable deposit and impose a reasonable cancellation charge, taking the circumstances of the cancellation into account.
4.3 The following cancellation structure applies to neoGraphy bookings, subject to the requirement that any cancellation charge must be reasonable in the circumstances:
More than 4 weeks before the event
The 30% booking fee will ordinarily be retained as the cancellation charge.
Any amount paid above the 30% booking fee will ordinarily be refundable, less any reasonable costs already incurred or services already performed.
3 to 4 weeks before the event
A cancellation charge of up to 50% of the total agreed booking value may apply.
Any amount paid above the applicable cancellation charge will ordinarily be refundable, less any reasonable costs already incurred or services already performed.
2 to 3 weeks before the event
A cancellation charge of up to 75% of the total agreed booking value may apply.
Any amount paid above the applicable cancellation charge will ordinarily be refundable, less any reasonable costs already incurred or services already performed.
1 week or less before the event
A cancellation charge of up to 100% of the total agreed booking value may apply because the likelihood of neoGraphy replacing the booking at such short notice is substantially reduced and personnel, equipment and production resources may already have been committed.
Any cancellation charge will remain subject to applicable South African law and must be reasonable in the circumstances.
4.4 The cancellation percentages above are intended as a reasonable commercial cancellation structure and do not override the Consumer Protection Act or any other mandatory South African law.
4.5 When assessing the appropriate cancellation charge, neoGraphy may consider the nature of the services, the notice provided, the possibility of securing another booking for the date, work already performed, preparation undertaken, personnel allocated, equipment allocated, third-party costs and other reasonable expenses.
4.6 The cancellation structure is based on the principle that a date reserved exclusively for one Client may prevent neoGraphy from accepting another booking for the same date.
4.7 Where the amount paid exceeds the lawful and reasonable cancellation charge and other legitimate amounts owing to neoGraphy, the balance will be refunded to the Client.
4.8 Where the Client is unable to honour the booking because of the death or hospitalisation of the person for whom, or for whose benefit, the booking was made, neoGraphy will not impose a cancellation fee in accordance with Section 17 of the Consumer Protection Act.
5. REFUNDS
5.1 Refunds will be assessed in accordance with the Client's rights under applicable South African law and the circumstances of the cancellation.
5.2 Where a refund is due, neoGraphy will refund the amount properly due after taking into account any lawful and reasonable cancellation charge, completed services, authorised additional services and reasonable costs incurred in connection with the booking.
5.3 Amounts paid above the 30% booking fee do not automatically become forfeited merely because they were paid in advance.
5.4 Where neoGraphy has already performed part of the contracted services, the value of those services may be taken into account when determining the refund.
5.5 Reasonable non-refundable third-party costs incurred specifically for the Client's booking may be taken into account where legally permissible.
5.6 Nothing in these Terms excludes or limits any refund right that cannot lawfully be excluded under South African law.
6. RESCHEDULING AND POSTPONEMENT
6.1 Requests to reschedule must be made in writing.
6.2 Rescheduling is subject to neoGraphy's availability.
6.3 Rescheduling does not guarantee availability on the requested alternative date.
6.4 Where neoGraphy agrees to transfer the booking to another date, amounts already paid will be credited towards the rescheduled booking, subject to any reasonable additional costs caused by the change.
6.5 Where the new date has a higher applicable package or travel cost, the Client will be responsible for the difference.
6.6 If the requested alternative date is unavailable and the Client elects to cancel, the cancellation provisions will apply.
7. COVERAGE HOURS
7.1 Coverage begins at the agreed start time stated on the quotation or booking confirmation.
7.2 Coverage ends at the agreed end time.
7.3 Client delays, late arrivals, programme delays, venue delays, supplier delays, family delays and other third-party delays do not automatically extend the contracted coverage period.
7.4 neoGraphy is not responsible for moments missed because the Client, wedding party, family members, guests or suppliers were unavailable or late.
7.5 Additional coverage beyond the contracted period is subject to overtime charges and availability.
8. OVERTIME
8.1 Additional coverage beyond the contracted hours is charged at R1,000 per hour.
8.2 Overtime applies to additional photography, videography, livestreaming or other agreed production services.
8.3 Where the Client requests or authorises neoGraphy to continue working beyond the contracted coverage period, the applicable overtime charge will apply.
8.4 Overtime is subject to availability of the neoGraphy team and equipment.
9. CLIENT DELAYS
9.1 The Client is responsible for ensuring that the agreed schedule allows sufficient time for the contracted services.
9.2 Delays caused by the Client or persons associated with the Client do not automatically extend the booking.
9.3 neoGraphy is not responsible for missed photographs, footage, moments or deliverables caused by Client delays.
9.4 Where the Client's delay causes coverage to extend beyond the contracted period, overtime may apply.
10. TRAVEL AND LOCATION COSTS
10.1 Travel outside Gauteng will be charged separately at the applicable AA rate.
10.2 Parking, toll fees and reasonable accommodation costs required for the booking may be charged separately where not included in the quotation.
10.3 A change of venue or location after the quotation has been accepted may result in additional travel or production costs.
11. VENUE ACCESS AND PERMISSIONS
11.1 The Client is responsible for obtaining necessary permissions from venues, churches, event organisers, property owners and other relevant parties.
11.2 The Client must inform neoGraphy of known venue restrictions before the booking.
11.3 neoGraphy is not responsible for missed coverage caused by restrictions imposed by venues, churches, security, organisers, officiants or other authorised persons.
11.4 neoGraphy will comply with reasonable venue and safety restrictions.
12. CLIENT RESPONSIBILITIES
12.1 The Client must provide accurate information regarding the event, session, location, schedule and required services.
12.2 The Client is responsible for ensuring reasonable access to the people, locations and activities required for the agreed coverage.
12.3 Where specific people, photographs, groups, products, shots or moments are required, the Client must communicate those requirements in advance.
12.4 neoGraphy cannot guarantee a particular photograph, video clip, person, background, pose or moment where circumstances prevent it from being captured.
13. FAMILY AND GROUP PHOTOGRAPHS
13.1 For weddings and events requiring family or group photographs, the Client is responsible for identifying the relevant individuals.
13.2 The Client is encouraged to appoint a family representative or coordinator who knows the relevant family members and can assist neoGraphy in assembling groups.
13.3 neoGraphy is not responsible for delays caused by family members or guests who fail to attend the designated photography location.
14. MEALS AND BREAKS
14.1 For extended bookings, particularly weddings and full-day events, the Client or event organiser is responsible for making reasonable arrangements for meals and appropriate breaks for the neoGraphy team.
14.2 Crew meals are separate from Client or guest catering unless specifically agreed otherwise.
14.3 Failure to provide meals does not automatically entitle the Client to additional coverage time.
15. CLIENT APPEARANCE, WARDROBE, MAKEUP AND GROOMING
15.1 The Client is responsible for their own appearance, wardrobe, grooming, makeup, hair and personal preparation before and during the shoot or event.
15.2 neoGraphy is not responsible for issues arising from the Client's clothing, makeup, hairstyle, grooming or personal presentation.
15.3 This includes, without limitation:
(a) dirty, stained or damaged clothing;
(b) wrinkled clothing;
(c) incorrectly fitted clothing;
(d) visible underwear or unwanted items in pockets;
(e) inappropriate or unsuitable wardrobe choices;
(f) makeup that is uneven, smudged, excessive, incorrectly applied or otherwise unsuitable;
(g) hair styling issues;
(h) visible hair, makeup or grooming imperfections;
(i) stains from makeup or hair products;
(j) untidy nails, hands, shoes or other visible personal details;
(k) temporary skin conditions or other appearance-related issues;
(l) clothing or accessories that create unwanted reflections or visual issues; and
(m) any other appearance-related matter that existed before or during the photography or filming.
15.4 neoGraphy may provide reasonable guidance or make minor adjustments during the shoot where practical.
15.5 Minor editing may be performed as part of the normal editing process.
15.6 Major digital alterations, extensive skin correction, body reshaping, wardrobe correction, makeup reconstruction, object removal or other extensive retouching are not included unless specifically agreed and may attract an additional fee.
15.7 The Client acknowledges that photography and videography record the appearance of the subject as presented on the day.
15.8 neoGraphy cannot be held responsible for dissatisfaction arising from the Client's own makeup, wardrobe, grooming, styling or personal appearance.
This type of wardrobe and grooming responsibility is also expressly used by South African photography businesses in their terms.
16. SAFETY AND WORKING CONDITIONS
16.1 neoGraphy may refuse or suspend work where the working environment presents a serious and unreasonable risk to personnel, equipment or property.
16.2 The Client must take reasonable steps to ensure that neoGraphy personnel and equipment are not subjected to dangerous conditions.
16.3 neoGraphy is not required to place personnel or equipment in circumstances involving unreasonable physical danger, uncontrolled crowds, aggressive behaviour, hazardous substances or unsafe structures.
17. EQUIPMENT
17.1 neoGraphy will use professional equipment appropriate to the agreed production.
17.2 neoGraphy may substitute equipment where reasonably necessary.
17.3 Equipment selection remains at neoGraphy's professional discretion unless specific equipment has been guaranteed in writing.
17.4 The Client must not handle, move, operate or interfere with neoGraphy's equipment without permission.
18. TECHNICAL FAILURE AND DATA PROTECTION
18.1 neoGraphy will take reasonable professional measures to protect captured material.
18.2 Where reasonably possible, neoGraphy may use backup equipment or duplicate recording systems.
18.3 Photography and video production involve inherent technical risks.
18.4 Where a technical failure, equipment failure or data-related incident occurs despite reasonable professional precautions, neoGraphy will take reasonable steps to minimise the impact.
18.5 Nothing in this clause excludes liability that cannot lawfully be excluded.
19. WEATHER AND ENVIRONMENTAL CONDITIONS
19.1 Outdoor photography and videography are subject to weather and environmental conditions.
19.2 neoGraphy may alter locations, schedules, compositions or shooting arrangements where weather or environmental conditions make the planned coverage unsafe or impractical.
19.3 neoGraphy is not responsible for missed photographs, footage or locations caused by rain, extreme heat, wind, storms or other environmental conditions beyond its reasonable control.
19.4 Where reasonably possible, neoGraphy will work with the Client to identify alternative arrangements.
20. CREATIVE STYLE AND EDITING
20.1 The Client acknowledges that photography and videography are creative services.
20.2 The final work reflects neoGraphy's established creative style.
20.3 Final decisions relating to composition, framing, colour grading, editing, sequencing and artistic presentation remain with neoGraphy unless otherwise agreed in writing.
20.4 neoGraphy is not required to provide every photograph or video clip captured during production.
20.5 Extensive retouching, object removal, background replacement, body alteration or other major manipulation is not included unless expressly agreed.
21. PHOTOGRAPHY DELIVERY
21.1 Standard photography delivery is within 6 weeks from the date of the session or event unless another period is stated in the quotation.
21.2 Delivery timelines may vary according to workload, project complexity and circumstances outside neoGraphy's reasonable control.
21.3 Final images will be delivered using the agreed digital delivery method.
22. VIDEO DELIVERABLES
22.1 neoGraphy does not provide full-length wedding or event videos as a standard deliverable.
22.2 Video packages provide a professionally edited highlights film/recap, unless the quotation expressly states otherwise.
22.3 The recap is a creative representation of the event and its final duration is not fixed.
22.4 The length of the recap will depend on what happens on the day, the amount of usable footage captured, the story of the event and the creative requirements of the edit.
22.5 Where appropriate, the highlights film may include selected portions of speeches, vows, announcements, interviews, music and other audio captured during the event.
22.6 The inclusion and length of speech extracts are determined by the content captured and the creative requirements of the final film.
22.7 neoGraphy does not guarantee that every speech, message, song, performance or event moment will appear in the highlights film.
22.8 Unedited footage is not included unless expressly agreed in writing.
22.9 Requests for a full-length documentary edit, full ceremony edit, full speeches, full reception recording or other extended video deliverable will constitute an additional service and require a separate quotation.
23. VIDEO REVISIONS
23.1 The package includes the edit described in the quotation.
23.2 Additional revisions or changes outside the agreed scope may attract additional charges.
23.3 Changes to the creative direction after editing has commenced may be treated as additional work.
24. BACKUP AND FILE STORAGE
24.1 neoGraphy will retain a backup of final delivered work for 14 days after delivery.
24.2 The Client is responsible for downloading and securely storing delivered files.
24.3 After the 14-day backup period, neoGraphy is under no obligation to retain or recover the Client's files.
24.4 The Client should maintain independent backups of all delivered photographs and videos.
25. RE-UPLOADS AND FILE RETRIEVAL
25.1 Once the Client has received the final delivery link, the Client is responsible for downloading and securely storing the files.
25.2 Where the Client requests a re-upload after the original delivery link has expired, been removed or become inaccessible, neoGraphy may charge a re-upload and file retrieval fee at the prevailing industry rate.
25.3 The applicable fee will depend on the age, location and accessibility of the archived files and the work required to retrieve and re-upload them.
25.4 As an indication, South African providers currently charge retrieval/re-upload fees ranging from approximately R247 to R500, depending on their storage and retrieval arrangements.
25.5 neoGraphy may update its prevailing re-upload fee from time to time.
25.6 A re-upload request does not guarantee that files will still be available after the stated backup period.
26. RAW FILES AND SOURCE MATERIAL
26.1 RAW photographs, unedited video footage, original camera files, project files, editing timelines, audio project files and other production source materials are not included unless expressly stated in the quotation.
26.2 Delivery of edited photographs or videos does not constitute delivery of RAW files or production files.
26.3 RAW files or source material may be supplied at neoGraphy's discretion and may attract an additional fee.
27. COPYRIGHT AND INTELLECTUAL PROPERTY
27.1 Photographs are protected as artistic works under the South African Copyright Act 98 of 1978, as amended.
27.2 Copyright ownership in commissioned works will be determined in accordance with applicable South African copyright legislation and the written agreement between neoGraphy and the Client.
27.3 Where the parties intend to assign copyright or grant exclusive rights, that arrangement must be expressly recorded in writing.
27.4 Payment for photography or videography does not automatically grant unrestricted commercial exploitation rights or ownership of RAW files, project files or production materials.
27.5 Any copyright assignment or exclusive licence must be recorded in writing.
27.6 Once all amounts due have been paid, the Client receives the agreed usage rights in the final delivered work.
27.7 The Client may not sell, sublicense, commercially exploit, materially alter, resell or transfer the work beyond the agreed purpose without the necessary rights.
28. CLIENT USAGE RIGHTS
28.1 Private clients may use final delivered photographs and videos for personal use, personal social media and sharing with family and friends.
28.2 Commercial clients may use the work for the commercial purposes agreed in the quotation.
28.3 Expanded advertising, paid media, resale, licensing, third-party use or other commercial exploitation may require an additional licence.
29. PORTFOLIO AND PROMOTIONAL USE
29.1 Unless otherwise agreed in writing, neoGraphy may use selected photographs and video footage for its portfolio, website, social media, advertising, competitions, marketing and promotional activities.
29.2 A Client requiring confidentiality or no promotional use must communicate this requirement in writing before the production.
30. LIVE DVD PRODUCTION
30.1 Where a Live DVD recording is booked, neoGraphy will provide the deliverables specifically stated in the quotation.
30.2 Live DVD production may include multi-camera recording, audio capture, editing, colour grading, graphics, mastering and other production elements depending on the selected package.
30.3 The final deliverable and format will be determined by the quotation.
30.4 Full unedited camera footage is not included unless expressly stated.
30.5 Additional editing, versions, revisions, duplication, mastering, physical media or additional deliverables may attract additional charges.
31. MUSIC VIDEO PRODUCTION
31.1 Music video production will be performed according to the agreed creative brief, quotation and production requirements.
31.2 The Client or artist is responsible for ensuring that they have the necessary rights to the music, lyrics, performances, trademarks, locations and other third-party material supplied for the production.
31.3 Location fees, models, actors, makeup artists, stylists, props, transport, accommodation, permits, special equipment and other production costs are not included unless expressly stated in the quotation.
31.4 Additional shooting days, locations, scenes, revisions, edits or production requirements may attract additional charges.
31.5 The final music video will be delivered in the format and specification stated in the quotation.
31.6 RAW footage and project files are not included unless expressly agreed.
32. THIRD-PARTY MATERIAL
32.1 The Client is responsible for obtaining the necessary permissions, licences and clearances for music, artwork, photographs, trademarks, footage or other copyrighted material supplied by the Client.
32.2 The Client warrants that they have the necessary rights to provide such material to neoGraphy.
32.3 Where third-party licensing is required, responsibility for obtaining and paying for such licensing will be agreed before production.
33. LIVESTREAMING
33.1 Livestreaming depends on internet connectivity, electricity, venue access, platform availability and compatible equipment.
33.2 neoGraphy cannot guarantee uninterrupted livestreaming where the service depends on third-party infrastructure.
33.3 Where livestreaming fails because of circumstances outside neoGraphy's reasonable control, neoGraphy will take reasonable steps to restore or continue the service where possible.
34. DRONE AND SPECIALISED EQUIPMENT
34.1 Drone operations are subject to applicable aviation laws, regulations, permissions, weather conditions, location restrictions and safety requirements.
34.2 neoGraphy may decline to operate a drone where legal, safety or weather conditions make operation inappropriate.
35. THIRD-PARTY SUPPLIERS
35.1 neoGraphy is not responsible for the acts, omissions, delays or failures of third-party suppliers engaged independently by the Client.
35.2 This includes venues, wedding coordinators, DJs, MCs, caterers, decorators, musicians, livestream platforms, internet providers and other service providers.
35.3 Where a third party's actions materially affect neoGraphy's ability to perform, neoGraphy will not be responsible for resulting missed coverage to the extent permitted by law.
36. FORCE MAJEURE
36.1 neoGraphy will not be liable for failure or delay caused by circumstances reasonably beyond its control.
36.2 Such circumstances may include severe weather, natural disasters, fire, flooding, civil unrest, road closures, government restrictions, serious illness, accidents, power failures, venue closures, unforeseen equipment failure or other circumstances that materially prevent performance.
36.3 Where reasonably possible, neoGraphy will attempt to provide an alternative solution, replacement personnel or rescheduled service.
37. EMERGENCY REPLACEMENT
37.1 If the primary neoGraphy photographer or videographer becomes unavailable due to serious illness, accident or another emergency, neoGraphy may provide a suitably qualified replacement where reasonably possible.
37.2 Where a replacement cannot reasonably be arranged, neoGraphy will communicate the circumstances to the Client and discuss an appropriate remedy.
38. CLIENT PROPERTY
38.1 The Client remains responsible for personal property provided to neoGraphy for production purposes.
38.2 neoGraphy will exercise reasonable care over Client property while it is in neoGraphy's possession.
39. CLIENT CHANGES TO THE SCOPE
39.1 Changes to the agreed services after booking may affect price, personnel, equipment, schedule and delivery.
39.2 neoGraphy is not required to provide additional services that were not included in the original quotation.
39.3 Additional services must be paid for in addition to the original quotation.
40. QUALITY OF SERVICE
40.1 neoGraphy will perform its services with reasonable professional skill and care.
40.2 Nothing in these Terms is intended to remove the Client's rights under applicable South African consumer protection legislation.
40.3 Where a legitimate defect in the quality of the service is identified, neoGraphy will be given a reasonable opportunity to investigate and, where appropriate, remedy the issue.
41. LIABILITY
41.1 neoGraphy will exercise reasonable professional skill and care in performing the agreed services.
41.2 Subject to applicable law, neoGraphy will not be liable for indirect or consequential losses arising from circumstances outside neoGraphy's reasonable control.
41.3 Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
42. PERSONAL INFORMATION AND PRIVACY
42.1 neoGraphy may collect and process personal information reasonably necessary to provide the contracted services.
42.2 neoGraphy will handle personal information in accordance with applicable South African privacy legislation.
42.3 The Client must not provide neoGraphy with personal information belonging to another person unless the Client is lawfully entitled to provide that information.
43. CONFIDENTIALITY
43.1 Where the Client provides confidential business, commercial or personal information to neoGraphy, neoGraphy will take reasonable steps to maintain confidentiality.
43.2 Specific confidentiality or non-disclosure requirements must be agreed in writing.
44. ABUSIVE OR UNSAFE CONDUCT
44.1 neoGraphy personnel are entitled to reasonable protection from threats, harassment, intimidation, violence and abusive conduct.
44.2 Where such conduct creates an unsafe working environment, neoGraphy may suspend or terminate coverage.
44.3 Where coverage is terminated because of serious misconduct by the Client or persons under the Client's control, the Client remains responsible for amounts properly owing for services already performed and any lawful cancellation or termination charges.
45. CANCELLATION BY NEOGRAPHY
45.1 neoGraphy may cancel or suspend a booking where the Client materially breaches these Terms, fails to make required payment, creates an unsafe working environment or engages in unlawful or seriously disruptive conduct.
45.2 Where neoGraphy is unable to perform a booking for reasons not attributable to the Client, neoGraphy will take reasonable steps to provide an alternative solution or refund amounts properly refundable under applicable law.
46. COMPLAINTS AND DISPUTE RESOLUTION
46.1 The Client should raise complaints with neoGraphy in writing and provide sufficient information to allow the complaint to be investigated.
46.2 neoGraphy will be given a reasonable opportunity to investigate and respond.
46.3 The parties will attempt in good faith to resolve disputes before commencing formal proceedings where reasonably possible.
46.4 Nothing prevents the Client from exercising any statutory right to approach an appropriate consumer protection body, tribunal, court or other lawful dispute-resolution forum.
47. GOVERNING LAW
47.1 These Terms are governed by the laws of the Republic of South Africa.
47.2 Any dispute will be dealt with in accordance with applicable South African law.
47.3 Where legislation provides a mandatory right, remedy or jurisdiction, these Terms do not exclude that right, remedy or jurisdiction.
48. ENTIRE AGREEMENT
48.1 These Terms, together with the applicable quotation, invoice, booking confirmation and written amendments, constitute the agreement between neoGraphy and the Client regarding the relevant services.
48.2 The Client may not rely on representations inconsistent with the written agreement unless confirmed in writing by an authorised representative of neoGraphy.
49. SEVERABILITY
49.1 If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be modified or severed only to the extent necessary.
49.2 The remaining provisions will continue to apply to the extent permitted by law.
50. NO WAIVER OF STATUTORY RIGHTS
50.1 Nothing in these Terms is intended to waive, remove, restrict or contract out of a right that South African law does not permit a supplier to exclude.
50.2 Where a provision conflicts with a mandatory provision of South African law, the mandatory legal provision will prevail to the extent of the conflict.
51. FINAL ACCEPTANCE
51.1 Payment of the booking fee, acceptance of the quotation, written confirmation of the booking or instruction for neoGraphy to commence work constitutes acceptance of these Terms.
51.2 These Terms apply to the relevant booking together with the applicable quotation and agreed package.
